Who is affected by the Waste Act and the Act on Maintaining Cleanliness and Order in Municipalities?
Legal provisions stemming from the Waste Act and the Act on Maintaining Cleanliness and Order in Municipalities impose various obligations on different types of businesses. These include companies such as:
- Vehicle dismantling stations,
- Facilities processing used electrical and electronic equipment,
- Waste generators,
- Entities collecting and processing waste,
- Entities operating landfills and dumps.
Additionally, it also applies to entities engaged in activities involving the extraction of waste from a waste landfill or waste dump (based on permission to extract waste or a decision approving the instructions for operating a waste landfill in the post-exploitation phase).
These laws also apply to companies involved in tank cleaning, conducting facility renovations, and many others. If your company falls into this category, it is obligated to register in the BDO system and maintain waste records using waste transfer cards, municipal waste transfer cards, and waste records cards. Furthermore, the company is required to submit an annual report on waste, products, and packaging management to the relevant provincial marshal.
What are BDO reports?
BDO reports are documents that companies must prepare and submit regarding the generation, collection, and processing of waste, as well as products and packaging. They are essential for waste management and compliance with environmental regulations.
The waste generation report should align with the waste record-keeping. It must be submitted to the relevant provincial marshal’s office, depending on the company’s operational location.
Similarly, the product and packaging report must reflect the data from the records of packaging and products. The annual report should be submitted to the provincial marshal based on the company’s registered office.
Who is obliged to submit BDO reports?
Annual reports on products, packaging, waste management, and waste generation are prepared in the BDO database for the reporting year by:
- Companies introducing packaging – this applies to both domestic and export-oriented companies.
- Entities introducing products in packaging – including exporters and entrepreneurs involved in intra-Community supplies.
- Manufacturers and distributors of products – for example, companies dealing with oils, lubricants, tires.
- Companies involved in vehicle recycling – introducing vehicles to the market in accordance with the Vehicle Recycling Act.
- Companies introducing equipment or authorized representatives.
- Those introducing batteries or accumulators, as specified in the Battery and Accumulator Act of April 24, 2009.
- Companies generating waste.
- Companies engaged in waste collection.
- Companies involved in waste processing.
- Companies dealing with municipal waste management.
Entities engaged in economic activities involving the reuse of waste are also required to submit reports in the BDO register.
When do we submit the BDO report?
Reports should be submitted by March 15th each year for the previous calendar year to the relevant voivodeship marshals through an individual account in the BDO system. To submit a report, companies must register in the BDO system using an individual username and password. Identifying data for entrepreneurs are obtained from the relevant voivodeship marshal after processing the registration application.
When is the BDO report not required?
A company is not required to submit a report in two cases:
- If it did not generate any waste in the given reporting year.
- If it did not process or introduce waste into circulation in the given reporting year.
