The waste transport service provider is required to have, during the waste transport, a confirmation generated from the Database on Products, Packaging, and Waste Management. This confirmation allows verification of the compliance of the information contained in the Waste Transfer Note with the actual state of affairs.
Who is obligated to issue a Waste Transfer Note, and why is it important?
The Waste Transfer Note is prepared by the waste holder who transfers them to the next entity or to the waste collection or processing locations managed by them. This must be done before the waste transport begins.
According to waste regulations, entities that do not fulfill their obligations, such as not having a confirmation generated from the BDO system during waste transport, are subject to a fine. Therefore, it is essential to pay attention to the correct preparation of the Waste Transfer Note to avoid negative financial consequences.
When is it not necessary to prepare a waste transfer note?
A waste transfer note is not required to be prepared if one of the waste holders is not subject to the obligation of keeping waste records. Those exempt from this obligation include:
- producers of municipal waste,
- producers of waste in the form of vehicles withdrawn from use, if these vehicles have been transferred to a business operating a dismantling station or a business operating a vehicle collection point,
- farmers managing agricultural land below 75 hectares,
- producers of construction and demolition waste from construction work carried out by individuals who are not entrepreneurs,
- individuals and organizational units not being entrepreneurs who use waste for their own needs.
Another case where there is no need to issue a waste transfer note is the transport of waste outside the territory of the Republic of Poland or the import of waste into the territory of the Republic of Poland. It is also worth noting that the waste transfer note does not have to be prepared by the entity that accepts waste from an entity exempt from the obligation to keep waste records. In such a situation, however, they should include the accepted waste in their record card, indicating the necessary information.
How to correctly prepare a waste transfer note?
A complete and diligently prepared waste transfer note should contain a series of essential data. The following information should be included:
- Date and time of the start of waste transport
- Date and time of their delivery to the next waste holder
- Registration numbers of waste transport vehicles
- Name of the waste holder, address of the waste origin location, and the entity’s headquarters address
- Data of the waste transport service provider – entity name, headquarters address, registration number
- Data of the entity taking over the waste, headquarters address, registration number, and the address to which the waste will be transferred
- Waste code in accordance with the waste catalog
- Type of waste (name) in accordance with the waste catalog
- Mass of the transferred waste (given in tons)
The waste holder receiving waste from another waste holder is obliged to confirm the takeover of the waste in the Waste Database (BDO) each time and promptly, providing the date and time of takeover. If the actual mass of the waste differs from the mass provided by the waste holder, the recipient should also add such information.
The obligation to promptly confirm the date and time in the Waste Database (BDO) also applies to the entity transporting the waste, as well as situations where waste is transferred to collection or processing facilities operated by its holder.
