What is BDO - Waste Database Overview?

BDO stands for Waste Database, which is a database containing information about products, packaging, and waste management. It is an integrated teleinformatics system that includes the BDO Register and modules for waste inventory and reporting. Administered by the Ministry of Environment, it is regularly updated by regional marshals. The various modules of the database, such as waste inventory and reporting modules, allow businesses registered in BDO to manage waste records and submit electronic reports related to waste management, products, and packaging.

For whom is registration in BDO mandatory?

The regional marshal automatically enters entrepreneurs into the BDO database who:

  • have obtained an integrated permit,
  • have obtained a waste generation permit,
  • hold a permit for waste collection or processing,
  • have received an approval decision for the management program of extractive waste or a permit to operate a facility for the neutralization of such waste,
  • hold a concession for underground waste disposal.

Mandatory Registration in the BDO Register applies to:

Compulsory registration in the Waste Database Register applies to all:

  • Waste producers who are obligated to maintain waste records,
  • Transporters, collectors, or processors of waste who are obligated to maintain waste records,
  • Importers of products in packaging, tires, lubricating oils, lubricating preparations, certain vehicles, batteries or accumulators, electrical and electronic equipment,
  • Producers, importers, and purchasers of packaging from the European Union;
  • Operators of retail or wholesale trade units where plastic bags subject to recycling fees are offered,
  • Municipal waste collectors registered in the regulated activity register,
  • Operators of selective municipal waste collection points (operated independently by a municipality or jointly with another municipality or municipalities),
  • Waste sellers and waste trading intermediaries (even if they do not physically possess the waste),
  • Authorized representatives of foreign sellers of electrical and electronic equipment,
  • Recovery organizations, packaging recovery organizations, and electrical and electronic equipment recovery organizations,
  • Traders introducing single-use plastic products into circulation, introducing semi-finished tools containing plastic into circulation, and authorized representatives of foreign sellers of these products,
  • Operators of retail, wholesale, or gastronomic units where single-use plastic cups or containers (for food intended for direct consumption) or beverages or food packaged by the entrepreneur in these containers are offered,
  • Packagers of beverages or food in the aforementioned cups or containers and offering them through vending machines,
  • Operators of port waste reception facilities and operators of other equivalent waste collection systems,
  • Entities acting as entrepreneurs operating vehicle dismantling stations,
  • Operators of vehicle collection points.

Who is not subject to mandatory registration in BDO?

Not every entrepreneur operating in the waste industry is required to register in BDO. Exceptions include entrepreneurs who do not meet the criteria requiring registration.

Article 51, paragraph 2 of the Waste Act lists specific categories of entities exempt from the obligation to register in BDO. These include:

  • Individuals and organizational units not acting as entrepreneurs, producing waste solely for their own use, in accordance with Article 27, paragraph 8 of the Waste Act,
  • Entities owning land where municipal sewage sludge is applied for purposes specified in Article 96, paragraph 1, points 1-3, i.e., recovery involving the use of municipal sewage sludge in agriculture, understood as the cultivation of all crops for commercial trade, including crops intended for feed production, cultivation of plants for compost production, cultivation of non-food plants, and feed production.
  • Entities conducting non-professional activities in the collection of packaging waste and waste in the form of used consumer items, such as medicines and their packaging,
  • Entities transporting waste generated by themselves,
  • Entrepreneurs producing only municipal waste,
  • Entrepreneurs who sign contracts for services related to construction, demolition, renovation of facilities, tank or equipment cleaning, and maintenance and repairs,
  • Waste producers who are farmers managing agricultural land below 75 hectares, provided they are not subject to registration under Article 51, paragraph 1.
  • Entrepreneurs producing only waste with codes and quantities specified in the Minister of Climate’s regulation of December 23, 2019, regarding types of waste and quantities of waste for which there is no obligation to keep waste records.

The Minister of Climate’s regulation from the end of 2019 precisely defines which types of waste and in what quantities are exempt from the obligation to be recorded in BDO. Among the 46 types of waste exempt from this obligation are, for example:

  • Animal waste,
  • Bark and cork waste,
  • Concrete and concrete rubble from demolitions and renovations, brick rubble, other ceramic materials and equipment elements, wood, glass, and plastics;
  • Certain producers of packaging waste,
  • Some groups of hazardous waste, such as used equipment containing hazardous elements, mercury-containing batteries, or metal packaging containing residues of hazardous substances or contaminated by them,
  • Waste generated from the operation of printers and fluorescent lamps, provided they do not exceed the quantities for which there is no obligation to keep waste records.

Registration process in BDO step by step:

  1. Creating a user account.
  2. Providing the contact details of the entrepreneur.
  3. Adding information about the scope of the entrepreneur’s activities, waste management scope, and types of waste.
  4. Verification of the application by the competent authority.
  5. Acceptance of registration and creation of an account in the BDO registry.
  6. Assignment of the BDO registration number.

The registration application for entry into the BDO registry is submitted electronically through the BDO database. The application can only be submitted by a person with the status of the main user appearing in the registration documents of the company or a person acting based on granted power of attorney. Submitting an application that does not align with the actual circumstances, without the necessary attachments, results in its non-review.

The assigned registration number should be included in documents related to the entity’s activities in the field of products and waste, such as:

  • VAT invoices,
  • fiscal receipts,
  • sales-purchase agreements,
  • reports,
  • waste transfer cards,
  • waste record cards.

What documents are needed for registration?

The registration application must include the following list of documents:

  • Proof of payment of the registration fee – if required,
  • In the case of entities introducing equipment – a contract with the organization for the recovery of electrical and electronic equipment, if concluded, and confirmation of the provision of financial security, if required,
  • In the case of authorized representatives – a contract with producers of electrical and electronic equipment,
  • In the case of organizations dealing with electrical and electronic equipment or recovery organizations – a certificate of payment of an amount equal to the amount of the organization’s share capital to cover this capital or a declaration of payment of this amount,
  • In the case of entities introducing batteries or accumulators – information confirming voluntary participation in the eco-management and audit system (EMAS),
  • In the case of entities introducing vehicles – a contract concluded with entrepreneurs operating dismantling stations.
  • The registration and annual fees apply to entrepreneurs:
  • Introducing electrical and electronic equipment and their authorized representatives,
  • Introducing batteries or accumulators,
  • Introducing vehicles,
  • Producers, importers, and intra-Community buyers of packaging,
  • Introducing products in packaging into the country,
  • Introducing tires into the country,
  • Introducing lubricating oils into the country.

How to pay the registration fee?

The registration fee, as well as the annual fee, should be paid into the bank account of the marshal’s office corresponding to the location of your company or your place of residence. You can find information about bank account numbers on the websites of the relevant marshal’s offices.

You should pay the annual fee every year by the end of February. It’s important to note that in the year you paid the registration fee, you do not need to pay the annual fee. In such a case, the registration fee is considered as the annual fee.

Consequences of lack or incorrect registration

The legal consequences that a business may face for not submitting a registration application or submitting a registration application that does not accurately reflect the actual state of the business may include:

  • Imprisonment or fines for managing waste inconsistent with the information reported to the registry,
  • Imprisonment or fines for not submitting an application for registration/changes to the registry or for removal from the registry, or for submitting an application inconsistent with the actual state,
  • Administrative fines ranging from PLN 5,000 to PLN 1,000,000 for conducting business activities without the required registration,
  • Administrative fines ranging from PLN 5,000 to PLN 1,000,000 for not placing the registration number on documents related to the conducted activities covered by the BDO Registry entry,
  • Administrative fines ranging from PLN 2,000 to PLN 10,000 for transporting waste without registration in the BDO Registry,
  • Administrative fines ranging from PLN 1,000 to PLN 100,000 for failure to deliver waste by the waste transporter to the waste holder/destination specified by the service commissioning the waste transport.
